In order to take a loan from the creditor, if someone allows the immovable property of his right, ownership or enjoyment or any part thereof to be enjoyed by the creditor after the date of writing or a certain period of time, such property shall be deemed to be mortgaged.
(2) According to sub-section (1) if there is a provision that the creditor can enjoy the property pledged at the same time as the loan is given or after a certain period of time, it shall be deemed to be a pre-emptive mortgage and if there is a provision to enjoy the property in the event that the creditor does not repay the loan within the period determined by the creditor-asami to repay the loan.< br> (3) The property to be pledged should be of a nature that can be enjoyed by the person taking the pledge.
(4) Property that is not in one's right, ownership or usufruct or that will be acquired in the future cannot be given as a pledge.
